                                                                          THIS IS A NOTICE OF INTENT
 


This notice is issued in accordance with Federal Acquisition Regulation (FAR) section 5.201 to notify the public of a proposed contract action.


The North American Identification Classification System (NAICS) code is  811210 Electronic and Precision Equipment Repair and Maintenance


. The SBA size standard is f $34 million in average annual receipt. The proposed contract action is for a modification to an exisiting contract under which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302(c)(1).


The statutory authority permitting other than full and open competition is 41 U.S.C.253(c)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled “3304(a)(1) sole source specifications, which reads in part, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”


The U.S Agency of Global Marketing (USAGM) intends to modify contract no. 951700-21-F-0193 awarded to Tower Facilities Management, LLC (Tower FM) for replacement, repair and maintnenance of our Uninterupted Power Supply (UPS) systems manufactured by General Electric, due to an urgent requirement for UPS replancement and repair.  The mission critical requirement is necessary to provide back-up power to the building should an unforeseeable  power outage occur.  If power to the building fails, there would be operational delays due to system disruptions.


The Voice of America (VOA) and  United States Agency for Global Media (USAGM) have an immediate and most urgent requirement to procure certified General Electric (GE) manufacture technicians to provide maitnenace services to replace 2 Module Inv/Rectifier, 1 module Booster and 1 Bridge Can Bus Cable necessary for the repair of UPS#2 located int the UPS Room Garage Level 330 Independence Avenue, Washington, DC, 20237. This UPS repair will provide back-up power for our critical infrastructure to the building needed to support the agncey's mission.


Tower FM is the only contractor known to immediate respond to this emergency and perform repairs on the General Electric (GE) Uninterrupted Power Supply (UPS) systems supporting this requirement. Tower FM maintains proprietary rights and access necessary to service GE UPS equipment, and its technicians possess specialized factory training that uniquely qualifies them to diagnose, repair, maintain, and provide technical recommendations for these systems with in 48 hours.


Due to its exclusive authorization and specialized expertise, Tower FM is capable of ensuring repairs are performed in accordance with GE manufacturer's specifications and operational requirements. Utilizing Tower FM minimizes operational risk, supports system reliability, and helps ensure continued performance of critical power infrastructure. No other known source can provide the same level of authorized support, proprietary knowledge, and factory-trained technical services required for these GE UPS systems within the required timeframe.
