Equal Employment Opportunity (EEO) and Non-EEO Workplace Investigations

This contract, solicited by the Administration-Civil Rights Division of the Regional Transportation District (RTD) in Denver, Colorado, seeks a qualified firm to provide independent, neutral fact-finding services for workplace investigations. These investigations will address allegations of harassment, discrimination, retaliation based on protected status, and other workplace misconduct under Equal Employment Opportunity (EEO) guidelines. The primary work involves confidential investigations conducted mainly remotely, supplemented by in-person interviews when necessary, culminating in comprehensive Confidential Investigation Reports that detail findings, witness statements, and conclusions based on a preponderance of evidence standard. The contract emphasizes adherence to all applicable federal, state, and local laws, as well as prevailing standards of investigative practice in Colorado. The contract is firm fixed price with a period of performance beginning May 13, 2026, for one base year plus two one-year option periods and a possible six-month extension, totaling up to three and a half years. While specific pricing data is not provided, labor hour estimates for EEO and non-EEO investigations are outlined for each period. Evaluation of proposals will prioritize firm experience and qualifications (30%), staff qualifications and availability (25%), cost (25%), and technical response quality (20%), using a best value, trade-off methodology rather than a low-price emphasis. Invoicing is electronic via email, with contract administration centralized at RTD without designated COR/COTR roles specified. Key contract conditions prohibit offerors involved in SOW preparation from bidding due to conflicts of interest, require OCI certification, and mandate professional certifications and qualifications for investigators. Deliverables must conform to performance and quality standards, with RTD retaining oversight through review and acceptance processes. The solicitation mandates electronic proposal submission with strict formatting and page limits, ensuring confidentiality and compliance with Colorado’s public records laws. No security clearance or special packaging is required, and insurance coverage is stipulated, but no performance or payment bonds are necessary. Overall, the contract is structured to secure experienced, impartial investigative services that reinforce a compliant and equitable workplace environment.
