Construction
Construction contractors on nonexempt federal projects must comply with affirmative action requirements, and contracting officers must coordinate with OFCCP to ensure proper oversight and notification.
Overview
FAR 22.804-2 outlines the affirmative action requirements for construction contractors holding nonexempt federal contracts. It mandates compliance with contract-specific affirmative action clauses and federal regulations (41 CFR 60-1 and 60-4), which set goals for minority and female participation in construction trades. Agencies must maintain and update lists of geographic areas subject to these requirements, and contracting officers must consult the OFCCP for guidance when working in areas without established goals. Additionally, contracting officers are required to notify the OFCCP regional office within 10 working days of awarding a covered construction contract, providing detailed contract and contractor information. When requested, a compliance conference must be arranged among relevant parties to clarify responsibilities.
