The Department of Veterans Affairs is issuing a firm-fixed price order for the purchase of Stereo Investigator Software and Modules specifically designed for the VA Eastern Colorado Health Care System's Microscopy and Imaging Core Facility. The contract includes a comprehensive suite of hardware and software products such as advanced stereology software for 3D imaging analysis, various extension modules for enhanced image processing capabilities, integration modules for motorized microscope control, cameras, workstations, monitors, and uninterruptible power supplies. Additionally, on-site installation and training over multiple days are included to ensure proper integration and user proficiency. The total estimated cost for the acquisition is approximately $71,866. This procurement is justified as a sole-source acquisition under statutory authority permitting restricted competition, based on the unique capability of MBF Bioscience to retrofit existing Zeiss Axioplan2 microscopes with custom hardware and driver files that integrate tightly with prior investments, such as the existing motorized Prior xy stage. MBF Bioscience is identified as the only responsible source fully capable of meeting the agency’s requirements without requiring the costly replacement of existing microscope stages, a limitation noted with alternative suppliers like Visiopharm, who offer turnkey systems at significantly higher costs. Market research confirms no other manufacturers can fulfill these precise compatibility and functionality needs, but future acquisitions may pursue broader competition should alternative options arise. The contracting officer has determined that the pricing is fair and reasonable based on comparisons with similar products and services.

Identification of the statutory authority permitting other than full and open competition: The statutory authority permitting other than full and open competition is 41 U.S.C.253(C)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1(c) "Only one responsible source and no other supplies or services will satisfy agency requirements- Application for brand name descriptions." V. Rationale Supporting Use of Authority Cited Above: MBF Bioscience is the only company that is able to retrofit the existing Zeiss Axioplan2 microscope platform to carry out Stereological image analysis. We are not just ordering additional software for our syste. MBF Bioscience is custom manufacturing key hardware components to be added to the Zeiss microscope to carry out these types of investigations. MBF Bioscience is also producing driver files so that all of our existing hardware will function as it does now once the system retrofit is complete. MBF Bioscience is also able to utilize the existing $20,000 motorized Piror xy stage. Visiopharm would require the re-purchase of a new replacement stage, discontinuing the existing Piror xy stage in its place. VI. Efforts to Obtain Competition: This action will be synopsized and published in the Government Point of Entry (GPE), FedBizzOpps. VII. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer determined that the anticipated cost to the Government will be fair and reasonable based on comparison of pricing of similar products and with other facilities procuring the same services, Negotiations with the offeror to ensure most advantageous pricing will be performed if the opportunity exists. VIII. Market research: Market research has demonstrated that at this time the identified manufacturer is the sole source manufacturer and distributor for this specific stereo investigator equipment. One other company, Visiopharm, was found to sell similar systems. Visiopharm is unable to upgrade the current system because they only sell turnkey systems at twice the price MBF Bioscience does. IX. Actions to Increase Competition: In future acquisitions for this requirement, the agency will work with the program office to perform additional market research so that other possible solutions can be considered. If other products become available that meet compatibility requirements with the existing hardware, solicitations for future requirements will utilize "brand name or equal" language, if it is in the Government's best interest to do so. As required by FAR 5.102 (a) (6) the Contracting Officer shall include the brand name justification within the solicitation. X. Any other facts supporting the use of other than full and open competition: None. Should it be determined that VISN 19 has a future requirement for this type service, the Contracting Officer will conduct a market survey to fulfill such requirement.
