Solicitation # 36C79126R0011
The Department of Veterans Affairs is soliciting proposals under Solicitation Number 36C79126R0011 to establish multiple single-award, Firm-Fixed-Price, Indefinite Delivery/Indefinite Quantity (IDIQ) base contracts for the Electro-Therapeutic Modalities for Pain Management (ETMPM) and Transcutaneous Electrical Nerve Stimulation (TENS) Procurement Program. This national program provides FDA-cleared electro-therapeutic devices and accessories to VA Medical Centers and Community-Based Outpatient Clinics to support non-opioid pain management. The scope includes portable TENS devices, Interferential Current (IFC) devices, thermal and non-thermal Short-Wave Diathermy devices, and portable Neuromodulation systems for headache disorders, along with associated accessories such as electrodes and lead wires. The procurement utilizes a VA Tiered Set-Aside Evaluation Approach, prioritizing awards sequentially from Tier 1 (SDVOSB), Tier 2 (VOSB), Tier 3 (Other Small Businesses), to Tier 4 (Other-Than-Small Businesses). Evaluation methodologies vary by item: CLINs X001 through X004 are evaluated using the Lowest Price Technically Acceptable (LPTA) method, where price is the deciding factor, while CLIN X005 is evaluated via a Best-Value Tradeoff, weighting technical factors at 60%, price at 25%, and past performance at 15%. Responsive proposals must include a signed SF 1449, a Technical Capability Statement, FDA 510(k) clearance letters, and three past performance documents. Non-manufacturers must provide OEM-issued Authorized Distributor Letters. Mandatory certifications include the Buy American Certificate for small businesses (Tiers 1-3) and the Trade Agreements Certificate for large businesses (Tier 4), as well as the Limitations on Subcontracting certification. All offerors must submit required product samples to the Denver Logistics Service facility. Following several amendments, the final deadline for all proposal documentation and product samples is November 2, 2026, at 12:00 PM CDT.

The Southern Regional Contracting Office - West at Brooke Army Medical Center executed an urgent sole source procurement for Abiomed Blood Pumps under solicitation W81K0012T0072. These life saving devices are surgically implanted in open heart patients who cannot be weaned from heart lung machines. Due to the critical nature of the equipment and the fact that existing stock was set to expire on March 31, 2012, the acquisition was fast tracked to ensure uninterrupted availability for patient care and the hospital medical mission. This action was conducted using other than competitive procedures pursuant to FAR Part 13.106-1(b)(1) and FAR Part 13.5, as the urgency of the requirement deemed a single source reasonably available. The procurement fell below the simplified acquisition threshold, allowing the contracting officer to obtain price and availability telephonically and bypass standard advertising requirements under FAR Part 5.202(a)(2). The award was finalized on March 28, 2012, under NAICS code 334510.

Full Description

This contract action was accomplished using other than competitive procedures because the procurement is awarded to a sole source under the Test Program for Certain Commercial Items (FAR 13.5). See posted J&A for further information. PRIORITY 3 ACQUISITION MEMORANDUM FOR RECORD FOR OTHER THAN FULL AND OPEN COMPETITION BELOW THE SIMPLIFIED ACQUISITION THRESHOLD 1. Contracting Agency: Southern Regional Contracting Office - West, Brooke Army Medical Center (BAMC), Fort Sam Houston, TX 78234 2. Description of Action: Urgent procurement of Abiomed Blood Pumps. 3. Description of Products/Services: The Abiomed Blood Pumps are life saving devices that are surgically implanted when an open heart patient is unable to be weaned from the heart-lung machine. 4. Authority Cited: -Pursuant to FAR Part 13.106-1(b)(1), Soliciting competition. For purchases not exceeding the simplified acquisition threshold, contracting officer may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency). -Pursuant to FAR Part 5.202(a)(2), Exceptions. The unusual and compelling requirement will not be advertised. -Pursuant to FAR Part 13.106(c)(1), Soliciting competition. Price and availability will be obtained telephonically. 5. Reason for Cited Authority: The above statutory authority is cited because this is a true, urgent request that has been verified by Janet Rindorf on 27Mar12. The Abiomed Blood Pumps must be available and always on hand because the physician does not know a head of time if weaning will be successful. The current stock is set to expire on 31Mar12 and policy dictates the hospital always have the pumps available. If the physician does not have the Abiomed Blood Pumps available, it could be detrimental to the patient's life as well as the hospital's overall medical mission. 6. Contracting Officer Certification: I certify this justification is accurate and complete to the best of my knowledge and belief.
