The State University of New York (SUNY) has awarded a single-source contract to Broadcast Music Inc. (BMI) for a blanket license covering the licensing of copyrighted musical works from July 1, 2024, through June 30, 2029. This license is essential for SUNY to legally perform copyrighted music publicly across all New York State counties, in compliance with copyright law. Since only three entities in the U.S. administer such licenses, and price negotiations are not possible, obtaining a blanket license from BMI offers a more efficient and cost-effective solution than acquiring individual licenses for each copyrighted work. The contract, valued between $500,000 and $2,000,000, is set to end on August 27, 2025, and covers all locations within New York State. This procurement is classified as a sole-source award, exempt from advertising requirements, due to BMI being the only provider authorized for this type of licensing. Any inquiries related to this contract or the exemption should be directed to Erik Finkell, the Contract Administrator for SUNY. The contract underscores the importance of maintaining a comprehensive licensing agreement to ensure legal compliance while streamlining the licensing process for publicly performed musical works across the university system.
