AI Contract Overview
The Defense Logistics Agency Energy is soliciting offers under solicitation number SPE60426R0401 for the supply of retail electricity and ancillary services to Department of Defense and Federal Civilian agency facilities located in Texas within the ERCOT market area. The contract covers a 24-month delivery period from January 2027 to January 2029, with an estimated total electricity requirement of 841,665,759 kWh across 19 Contract Line Item Numbers, and includes a holdover CLIN extending performance through April 2029 to manage market transition risks. Offers are being sought under Firm Fixed-Price and Real-Time Settlement Point Pricing (RTSPP) structures, with specific CLINs designated for RTSPP pricing and the option for the Government to convert certain RTSPP-based line items, notably Dyess Air Force Base, to Firm Fixed-Price during the performance period. All pricing must reflect retail supply costs excluding TDSP charges, gross receipts tax, and PUC assessments, which are direct pass-throughs with no markup. The contract requires compliance with Texas Public Utility Commission billing standards, consolidated REP billing, and specific invoice formatting, including separate line items for transaction fees and retail adders, with electronic invoicing via WAWF mandated for CLIN 0004. Offerors must possess a current Unique Entity Identifier and CAGE code, maintain active SAM.gov registrations with accurate representations and certifications, and demonstrate eligibility to deliver retail electricity in Texas by the Public Utility Commission. Proposals must include a non-price submission per Attachment II, a completed Pricing Sheet TX2026, and optionally a Small Business Subcontracting Plan. The evaluation is based on best value, with price weighted approximately at 50% and non-price factors—past performance (most important), technical capability/risk, and small business participation—collectively weighted equally to price. Past performance will be assessed for recency, relevance, and quality using three references. The Government reserves rights to inspect and reject nonconforming deliveries, and requires contractors to notify the Contracting Officer of any after-imposed regulatory charges within 60 days to seek equitable adjustments via contract modification. The solicitation is not set aside for small businesses, is subject to the World Trade Organization Government Procurement Agreement and Free Trade Agreements, and applies FAR 52.212-4 with deviation 2026-O0038 as the core contract terms.
