This is a notice of intent to sole source. The Department of Homeland Security (DHS), Federal Emergency Management Agency (FEMA) intends to award a firm-fixed price sole source contract to L3HARRIS Technologies, Inc. for AN/PRC-163 handheld radio systems.


The statutory authority for this non-competitive action is 41 U.S.C. 3304(a)(1) as implemented by Revolutionary Federal Acquisition Regulation (FAR) Overhaul (RFO) Part 6.103-1, Only one responsible source and no other supplies or services will satisfy agency requirements. L3HARRIS Technologies, Inc. is the only manufacturer of the AN/PRC-163 handheld radio system and ancillary software. The radios must be capable of Type-1 encryption up to the TOP SECRET level and be capable of Type-3 AES encryption. The radios must support standard Line of sight (LOS), UHF SATCOM, HAVEQUICK, TSM/WREN, WREN-NB, and P25 conventional and trunking waveforms. The radios must be compatible with existing agency infrastructure.


This notice is not a request for quotations. Interested parties have fifteen (15) days from the date of publication of the Synopsis, to submit in writing up to two (2) pages, to the identified point of contact, clear and convincing evidence of their qualifications and/or capabilities. Such qualifications and/or capabilities will be used solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. Responses received after fifteen (15) days, or without the required information, will be considered non-responsive to this synopsis and will not be considered. A determination by the Government not to conduct this effort as a full-and-open competitive procurement, based upon responses to this notice, is solely within the Government's discretion. In the absence of qualified sources, a contract will be awarded under the Other than Full and Open Competition procedures, pursuant to 41 U.S.C. 3304(a)(1) as implemented by RFO 6.103-1, Only One Responsible Source utilizing the procedures of RFO 12.102(a) . All inquiries must be submitted in writing to the address stated herein and to the attention of Allison Brazzel, Contracting Officer. Response to this notice must be received no later than September 19, 2026, 5:00 P.M. Eastern Time.
