The USAF Academy requires the purchase of the Nihon Kohden Polysleep-921-1 polysomnogram system along with its related equipment and accessories. This acquisition is a Brand Name Only procurement because the 10th Medical Group has determined that no other product meets the necessary features and functionality. The Neurology Department at the Academy's clinic needs to equip two new sleep rooms with this specific polysomnogram to ensure compatibility with existing software and amplifiers used across six sleep rooms, maintaining seamless data interoperability. Additionally, this purchase supports compliance with Tricare network requirements and local neurologists’ practices, who also utilize Nihon Kohden equipment to perform mandated sleep studies. The contract involves delivery to the 10th Medical Group at the USAF Academy, Colorado, with FOB destination terms. Industry classification falls under NAICS code 334510, with a size standard of 500. While this synopsis is for notification and does not constitute a solicitation, responses from manufacturers of equivalent products are invited for consideration by June 25, 2009, to determine if a brand name or equal procurement will proceed. Interested parties must be registered in the Central Contractor Registration and Online Representations and Certifications Application systems. An ombudsman is appointed to confidentially address concerns related to the acquisition process, though contacting the contracting officer remains the primary step for inquiries and resolution. The points of contact for this procurement are Contract Specialist Matthew McLean and Contracting Officer Leslie Ryan at the USAF Academy.

Full Description

The USAF Academy has a Brand Name Only requirement to purchase the Nihon Kohden polysomnogram (Polysleep-921-1) and associated equipment and accessories. The 10th Medical Group has determined this to be the only product that meets all its required features and functionality based on the following justification. The Neurology Department at the USAF Academy Clinic has a requirement to equip two new sleep rooms with polysomnogram equipment and associated software and accessories. The only acceptable brand is manufactured by the Nihon Kohden Company. It is essential for the Neurology Department to maintain software and amplifier compatibility for data retrieval and utilization. No other brand will allow data interoperability, functionality and sharing among the six sleep rooms. In addition, the Tricare network and local private practice neurologists use Nihon Kohden amplifiers and software to perfom sleep studies. Utilization of a different brand would prevent access to sleep data mandated by Tricare. This notice document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-32, 31 Mar 09. The North America Industry Classification System Code [NAICS] is 334510 and the size standard is 500. Delivery is to be made to the 10th Medical Group at the U.S. Air Force Academy, CO 80840, FOB: Destination. This synopsis is for notification purposes only and does not constitute a solicitation for quotations, bids or proposals. Information received will be considered solely for the purpose of determining whether to conduct a brand name or equal procurement. A determination not to compete this proposed procurement based on response to this notice is solely within the discretion of the Government. All sources believing they have an equal product may submit a response, which if timely received, will be considered by this agency. Respondents must provide a product equal to the Nihon Kohden Polysleep-921-1. Responses must be received NLT 1600 (MST) on 25 June 2009. Responses received after this will be considered late IAW FAR 52.212-1(f) and will not be evaluated. The Government does not intend to pay for any information provided under this synopsis. Contractors must have a current registration with the Central Contractor Registration (CCR) at http://www.ccr.gov and with Online Representations and Certifications Application (ORCA) at http://orca.bpn.gov. Questions should be addressed to Matt McLean, Contract Specialist, USAF Academy by phone at +1 (555) 000-0000 or e-mail questions to contact@example.gov. 5352.201-9101 OMBUDSMAN (AUG 2005) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (c) If resolution cannot be made by the contracting officer, concerned parties may contact the USAF Academy Ombudsmen, Kelly Snyder 8110 Industrial Drive, Ste 103 USAFA, CO 80840 Telephone number +1 (555) 000-0000 FAX +1 (555) 000-0000 email: contact@example.gov Concerns, issues, disagreements, and recommendations that cannot be resolved at the MAJCOM/DRU level, may be brought by the concerned party for further consideration to the Air Force ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number +1 (555) 000-0000, facsimile number +1 (555) 000-0000. (d) The ombudsman has no authority to render a decision that binds the agency. (e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer. (End of clause) The USAF Academy has a Brand Name Only requirement to purchase the Nihon Kohden polysomnogram (Polysleep-921-1) and associated equipment and accessories. The 10th Medical Group has determined this to be the only product that meets all its required features and functionality based on the following justification.
