In accordance with FAR Subpart 6.302-1 entitled � �Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements,� the following information is herein documented regarding the non-competitive justification of the below-stated acquisition. USAGM intends to award a non-personal service contract to Olha Chornomaz to serve as a Marketing Representative for Ukraine and other designated countries. The base agreement is $30,900 (period of performance 2 November 2020 � 1 November 2021) with the option to extend for an additional two (2) one-year periods. The total value of this award shall not exceed $92,700. The action being approved herein is a non-competitive procurement of services required to meet the Agency�s need to place USAGM content on affiliate platforms in the region. The placement of this programming is vital to meet the ever-expanding requirements of the USAGM�s global broadcasting mission. Ms. Chornomaz has worked for IBB/BBG/USAGM since 2001. During this period, she has participated in USAGM�s marketing meetings where USAGM priorities and strategic goals were reviewed and discussed. She has promoted VOA, RFE/RL and Current Time programs at seminars, fairs and other settings, and helped with miscellaneous advertising issues. She has monitored the programs and the media in Ukraine and the region. She also assisted executives from Washington, DC during their travel through the region. Ms. Chornomaz has helped to expand the USAGM�s reach in Ukraine. During her time on the job, she has gained the experience to market USAGM programs and content in Ukraine. Her large network of media and advertising contacts in this region is critical for USAGM�s continued brand and network growth in the region. Olha has more than proven she can do the job. If her contract is not renewed, we run the risk of being handicapped by giving up the momentum we have established in this strategically important region. It is very difficult and expensive to send representatives from Washington, DC or from Prague, Czech Republic, to Ukraine to perform the marketing tasks that Ms. Chornomaz handles, and she has both the language capabilities and the career network to get the job done. USAGM has compelling reasons to establish a new follow-on contract with Ms. Chornomaz for another three years (base year plus two (2) 1-year option to extend the contract term). Per FAR Subpart 6.302-1, 41 U.S.C.253(c)(1) is the statutory authority permitting other than full and open competition for this acquisition, and it is herein cited as follows: �When the supplies or services required by the agency are available from �Only one responsible source, and no other type of supplies or services will satisfy agency requirements�, full and open competition need not be provided for. The nature of the proposed acquisition requires these unique services to be provided by Olha Chornomaz in order to ensure affiliate placement with existing affiliate broadcasters be maintained and current in-process affiliates be seen to fruition. USAGM herein certifies that Olha Chornomaz is the only agent that can meet USAGM�s requirement. The Contracting Officer, with the USAGM Authorizing Contracting Officer Representative (COR) for this procurement, has determined that the anticipated cost of the Government will be fair and reasonable. This is a notice of intent and is not a request for competitive quotations or proposals. No solicitation is available. Candidates that believe they can provide equal or superior service that are capable of meeting government�s needs are encouraged to identify themselves and provide a substantive statement with descriptive literature and any other supporting information to the Contracting Officer within 15 days of publication of this notice. All information received within 15 days of publication of this notice will be considered by the Government to determine if other candidate can meet the Government�s requirements and is capable by the contracting office no later than deadline provided in this notice. Responses may be e-mailed to atgartne@usagm.gov. Pursuant to Contract Subsection I.2 entitled, 52-232-18 AVAILABILITY OF FUNDS (APR 1984), funds are not presently available for performance under this contract beyond 1 November 2021. The Government�s obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond 1 November 2021, until funds are made available to the Contracting Officer for performance and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer
