The Department of Energy (DOE) intends to issue a sole-source, firm fixed-price contract to Standard & Poor's (S&P) for a period of six months to provide specialized rating methodologies necessary for assessing risk and calculating Probabilities of Default (PD) and Loss-Given Defaults (LGD) within their loan portfolio. Utilizing an exemption under the Competition in Contracting Act and Federal Acquisition Regulation 6.302-1(a)(2)(i), the DOE justifies this sole-source award based on S&P being the only responsible source capable of supplying these highly specialized credit and risk assessment models, which leverage a proprietary and extensive project finance database unique to their services. This action aligns with FAR requirements for issuing notice of such contract actions when competition is not feasible. This notice explicitly states that it is not a solicitation for competitive proposals, but invites other firms that believe they can meet the requirements to submit a written capability statement and pricing information by a specified deadline. Any decision to open competition will rest solely with the government. The contract will be managed through the DOE’s Office of Headquarters Procurement Services, and the notice emphasizes the importance of ensuring continued effective risk evaluation within DOE’s Loan Programs Office, which relies heavily on accurate and specialized credit risk modeling tools.
