Snow College has issued a notice of intent to award a contract to Business Source Elite (EBSCO) without engaging in a standard competitive procurement process, citing the Utah Procurement Code. This action is based on the determination that the procurement meets specific criteria, such as being a sole source provider, involving significant transitional costs, or existing under circumstances where a standard process is impractical and not in the best interest of the institution. The solicitation, identified as SNOC26271017, was posted on August 24, 2026, with a response deadline of September 7, 2026. Although the initial notice outlined the intent to award the contract, subsequent documentation indicates that no award will be made under this specific solicitation per Utah Code Annotated 63G-6a-802(3) and Administrative Rule R33-108-101. The procurement process for this notice has been closed out without an award, with the understanding that any future contract award related to these services will occur during a separate, later stage following further negotiations.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS
Snow College is publishing this notice pursuant to the Utah Procurement Code and is claiming that it intends to award a contract without competition if it is determined by Snow College, in writing, that:
- there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit.
In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
