NOTICE OF INTENT TO SOLE SOURCE


This notice is not a request for competitive quotes. NAVSUP FLCSD intends to award a sole-source contract.


NAVSUP FLCSD intends to solicit and award a commercial, sole source, firm-fixed-price (FFP) contract to EOS of North America, Inc., 28970 Cabot Drive, Ste. 700, Novi, MI, using the procedures in FAR part 12.201-1.


Competition is not feasible because the required controller and repair services for the EOS M100 3D Printer can only be provided by the original equipment manufacturer and its proprietary processes, making EOS of North America the only responsible source for this procurement.


Under FAR 12.102(a), only one source is reasonably available. NAVSUP FLCSD requires a proprietary process controller and repair services for the EOS M100 3D Printer for NPS. Only original equipment manufacturer (OEM) parts and services are acceptable due to the use of proprietary technology and diagnostic software, which are necessary to ensure compatibility with the existing system at NPS, maintain OEM warranty coverage, and meet required performance standards. Third-party or non-authorized service providers do not have access to the proprietary software, source codes, or technical documentation needed to perform the required maintenance and repairs.


Required services include procurement and installation of proprietary controller hardware and firmware, diagnostic testing, and OEM system calibration. The EOS M100 is proprietary; EOS of North America is the only source, as they own the source code and diagnostic software and do not license manuals or passcodes to others.

The decision to compete or proceed with a sole-source contract rests solely within the Government’s discretion. Any information provided in response to this Notice may only be used to determine the procurement method.
