Notice of Intent to Sole Source - Comcast Ethernet

The Consumer Product Safety Commission plans to renew its existing ethernet private line service with Comcast Business Communications LLC to maintain critical connectivity between its 5 Research Place facility in Rockville, MD and its headquarters at 4330 East West Hwy in Bethesda, MD. This service supports the last-mile infrastructure required for high-bandwidth data transmission, with existing Comcast infrastructure capable of delivering up to 10 Gigs of bandwidth. The contract also includes ongoing operation and maintenance of the WiFi infrastructure at the CPSC sample storage facility, which relies on the current Comcast service level agreement. The agency has determined that Comcast is the sole provider of this specific service because it owns and operates the physical last-mile connectivity between the two locations, and no other vendor can meet the requirement without undertaking costly and impractical new installations. The CPSC is proceeding under the authority of FAR 8.405-6(a)(1)(B), which permits sole source awards when only one responsible source exists and no other supplies or services can satisfy the agency’s needs. This is not a competitive solicitation, but any company that believes it can provide an equivalent service may submit written evidence to the Contract Specialist by 3 PM EST on August 11, 2026, to challenge the sole source determination. All submissions must be sent via email to ggrayson@cpsc.gov with sufficient detail to demonstrate capability, and no telephone inquiries will be accepted. The government retains full discretion to evaluate any responses and decide whether to proceed with a sole source award to Comcast or reopen the procurement. If no viable alternatives are received, the contract will be awarded directly to Comcast Business Communications LLC under solicitation number CPS-2240-26-0086.

XRF Handheld Analyzer

The Consumer Product Safety Commission is soliciting quotes for two handheld XRF analyzers under RFQ CPS-2112-26-0037, with an optional provision for up to sixteen on-site training sessions across the United States and an additional option for more units in FY27. All offerings must fully comply with the technical specifications in Attachment 1 and the evaluation criteria in Attachment 2, and vendors are required to schedule a live demonstration between July 17 and 28, 2026, at 5 Research Place, Rockville, MD, by contacting Greg Grayson. Quotes must be submitted via email no later than August 3, 2026, 3 PM EST, and must include the company name, address, point of contact details, phone number, and active SAM UEI number; phone inquiries are prohibited to maintain fairness. Delivery is FOB destination to Rockville, MD, within 30 to 60 days after award, with payment terms of 30 days following inspection, acceptance, and a properly submitted invoice through www.ipp.gov. The acquisition follows FAR Subpart 12.201 procedures for commercial items, with award going to the lowest price technically acceptable responsible offeror, considering conformance, ability to meet government needs, price, and delivery schedule. Offerors must have an active SAM registration that includes the required commercial items representations and certifications, and the government reserves the right to award without discussions. Questions must be submitted by July 23, 2026, 3 PM EST, to ggrayson@cpsc.gov.

Notice of Intent to Award Sole Source - Thermo XRF Repair Services

The Consumer Product Safety Commission plans to award a sole source contract to Thermo Scientific Portable Analytical Instruments for the repair and maintenance of Thermo Scientific Niton XL3t portable XRF analyzers used to screen consumer products for hazardous elements like lead. These devices are critical to the agency’s mission of ensuring product safety, and repairs must be completed promptly to return equipment to operational use in the field. Under FAR 6.103-1(b), the government asserts that Thermo Scientific is the exclusive manufacturer and authorized service provider for this specialized equipment, making competition unnecessary. The agency has issued a notice to allow any other potential provider to submit written evidence demonstrating their ability to perform the required services, but submissions must be received by 3 PM EST on June 3, 2026, via email to Greg Grayson, the Contract Specialist, with no phone inquiries accepted. All responses will be reviewed, though the government retains full discretion to proceed with the sole source award regardless of submissions. If no viable alternatives are presented, the contract will be negotiated directly with Thermo Scientific.
