Park-n-Ride (PNR) Passenger Activity Data Collection
Solicitation # RFP 126DP002
The Regional Transportation District (RTD) is soliciting proposals under RFP 126DP002 for qualified consultants to conduct a comprehensive Park-n-Ride (PnR) passenger activity data collection study within the Denver metropolitan region. The primary objective is to gather high-quality data on usage patterns, existing demand, and travel behavior, specifically focusing on vehicle entry and exit counts, parking utilization, vehicle occupancy, and bicycle and pedestrian activity. This information will be used to support travel demand model development, transit-oriented communities planning, joint development efforts, and future transit investments. This is a best-value, fixed-price contract with a one-year period of performance, which may be extended by RTD for up to six additional months. Proposals are due by November 20, 2026, and must be submitted electronically via RTD's online procurement portal. Requirements for respondents include the submission of a cover letter, a technical proposal not exceeding 20 pages, a lump sum pricing form, and certifications regarding background investigations and organizational conflicts of interest. Awarded contractors must ensure all personnel are qualified and have undergone background checks, and they must comply with federal transit laws, including Title VI of the Civil Rights Act and the Americans with Disabilities Act.

Full Description

The purpose of this notice is to cancel the solicitation in its entirety. The EPA did not clearly state its requirement in the current Statement of Work for this solicitation. EPA did not adequately describe its intended uses of the data (e.g., rulemaking and development of other policies) which necessitates that EPA be able to publish and disclose certain types of analyses of the data. Such uses might also require that EPA be able to retain raw data it uses in its analyses for a minimum of three (3) years, in order to comply with records retention schedules under the Federal Records Act. Furthermore, FAR 12.211 requires solicitations and contracts for technical data to include appropriate data rights provisions and clauses, but such provisions and clauses were not included in the solicitation. Finally, the EPA cannot agree to many of the standard terms and conditions included in licenses, including, but not limited to, indemnification provisions, statements to the affect that the license represents the entirety of the agreement between EPA and the vendor, and terms requiring disputes to be resolved by arbitration or in state courts under state law. A new solicitation will be forthcoming to address these issues in more detail.
