NOTICE OF INTENT TO SOLE SOURCE TO APEX INSTRUCTMENTS
Solicitation # NOTICE_OF_INTENT_TO_SOLE_SOURCE_TO_APEX_INSTRUCTMENTS
The Environmental Protection Agency Region III intends to award a sole-source, firm-fixed-price commercial contract to Apex Instruments, Inc. for the maintenance and renewal of an operational fleet of twenty-five APEX Air Pro ambient air monitoring units. The procurement, estimated at 41,000 dollars, includes one-year renewals for twenty-five data starter package subscriptions and one central administrative account, as well as eleven Nitrogen Dioxide and eight Volatile Organic Compounds replacement cartridges. This action is conducted under the authority of RFO Part 13, as Apex Instruments, Inc. is the exclusive North American distribution rights holder and certified warranty service provider for this proprietary hardware and software. The requirement is brand-specific to ensure compatibility with existing proprietary data ingestion and cloud mapping pipelines and to utilize patented hot-swappable Smart Gas Cartridge technology. Selecting an alternative platform would result in operational disruption and the obsolescence of current government inventory. While this is not a request for competitive proposals, responsible sources may submit capability statements, proposals, or quotations to Erin Workman by 4:00 pm EST on November 3, 2026, for the government to determine if competitive procurement is warranted. The contract falls under NAICS code 334513 and PSC code 6630.
