The contract under consideration involves a non-competitive sole-source extension with LexisNexis, identified as Contract 216120 Amendment 3, managed by the Utah Division of Purchasing in coordination with the Department of Workforce Services (DWS) Unemployment Insurance Division. This extension serves to maintain uninterrupted access to LexisNexis's critical legal research and fraud prevention services supporting the DWS Unemployment Insurance program. Due to the impracticality of standard procurement proceedings, transitional costs, and the need to avoid operational disruptions while a new cooperative contract is negotiated, the contract is extended beyond its original end date of July 30, 2025, now set through December 31, 2025, with a proposed further extension potentially into January 2026. The aggregated contract value has increased from an original $395,000 to a proposed total of $432,500 as a result of this extension and funding augmentation, reflecting a modest increase of approximately $17,500. This procurement is conducted under Utah Code Section 63G-6a-802 and corresponding administrative rules governing non-competitive awards when only one source is available, or competition is impractical and not in the procurement unit’s best interest. The process includes required public notice and an opportunity for other vendors to submit challenges with supporting documentation if they believe comparable procurement items can be provided, although vendor contact is strictly managed through the Division of Purchasing. No federal FAR clauses are applied; instead, state-specific administrative rules and forms govern contract execution, extensions, and funding increases. The scope emphasizes ongoing service delivery rather than introducing new specifications or technical criteria, with acceptance conditions inferred at the statewide place of performance in Utah. The contract ensures continuity of vital fraud prevention services during the transition to a new procurement vehicle, with mandatory compliance on confidentiality, anti-boycott certifications, and statutory reporting. Submission deadlines and proposal requirements are set forth with electronic submission mandates through the Utah Division of Purchasing portal by December 19, 2025. Overall, this contract demonstrates an administrative extension executed to prevent service interruption while adhering to state procurement law provisions for sole-source award authority and justifications.

General Info

Sole-source LexisNexis contract extended to December 2025, increasing value to $432,500, ensuring service continuity.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that:
there is only one source for the procurement item; transitional costs are a significant consideration in selecting a procurement item; or the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit.
In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
