AI Contract Overview

The contract involves a sole-source procurement process initiated by the Utah Division of Purchasing under the Utah Procurement Code, indicating that the award will be made without a competitive bidding process due to specific justifications such as the existence of a single available source, significant transitional costs, or impracticality of standard procurement methods. The vendor, Equifax Workforce Solutions LLC, is contracted to provide employment and income verification services, primarily through an automated system enabling real-time validation of employment data using Social Security Numbers, covering up to three years of pay period records. The contract's initial estimated value is approximately 1.4 million dollars, with provisions for annual minimum payments and options to extend the service period, potentially reaching a high ceiling of over 11 million dollars based on usage and extended periods. Supporting documentation details the scope of work, emphasizing the system’s ability to verify employment status, employer details, and income data to assist public assistance eligibility determinations and fraud detection efforts. The procurement notices specify that no formal FAR clauses or federal contract clauses are incorporated, as this is a state-level, sole-source award. The contract includes an amendment increasing the funds, and the procurement process requires vendors to submit comprehensive responses aligned with specific sections, including justifications for the non-competitive award, technical specifications, and pricing. The scope of performance includes system reliability, data accuracy, and customer support, with no explicit special contractual requirements such as security clearances or OCI clauses. Overall, the contract reflects a targeted, justification-based procurement process designed to secure specialized employment verification services without engaging in a standard competitive process.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that:
there is only one source for the procurement item; transitional costs are a significant consideration in selecting a procurement item; or the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit.
In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
