Under the authority of FAR 6.302?1, The Federal Highway Administration (FHWA), Central Federal Lands Highway Division (CFLHD), Lakewood, CO, intends to negotiate a sole source contract with "Symplicity Corporation, 1560 Wilson Blvd., Suite 550, Arlington, VA 22209" for the acquisition of Computer Programming and Hosting services. This notice is posted per FAR 5.201. Background Information This requirement is considered to be a continuation of a major system for the FLH and they are the original designer & developer of EEBACS and the system was developed to be hosted on their private cloud-infrastructure. As the designer and developer of EEBACS, Symplicity Corporation has system expertise; no other contractor would have any knowledge of EEBACS. The system is comprised of the work flow, equations, and requirements of the CFLHD design, bid, award, and administration process. Symplicity has worked on this system since 2006 and has extensive knowledge that is imperative for the continued develop and operation of the EEBACS system. To proceed with a full and open competition for this follow-on contract for a major system would result in a duplication of cost as well as unacceptable delays if the EEBACS system were to be inoperable. Furthermore, the effort to bring a contractor up to the same level of the institutional knowledge that the incumbent contractor offers would result in further duplication of costs. This is not a solicitation. This notice is not considered a Request for Quotation or Proposal. No solicitation document is available and telephone requests will not be honored. No contract will be awarded on the basis of offers received in response to this notice. All responsible sources may submit a capability statement proposal, or quotation, which shall be considered by the agency. If no responses are received by 2 p.m. MDT, July 23, 2015, the Government reserves the right to execute an award without publishing a solicitation. A determination by the Government not to compete this proposed contract is solely within the discretion of the Government. Responses must be submitted to contact@example.gov no later than the time and date noted above.
