This requirement is for the immediate procurement of contractor services to support CBP and the Office of Chief Counsel (OCC) in responding to significant and unprecedented demands for the review and production of information associated with CBP’s litigation portfolio and operational activities. The information that requires review may include but is not limited to body-worn camera footage, surveillance video, forensically examined mobile device data, investigative reports, enforcement records, operational documents, photographs, audio files, communications, and other data generated, collected, or maintained during CBP operations. Before disclosure, OCC must identify, protect, and, where appropriate, redact privileged, sensitive, protected, or otherwise legally restricted information. This includes information protected under the Privacy Act, 5 U.S.C. § 552a; applicable Freedom of Information Act exemptions; law enforcement sensitivities; attorney-client privilege; attorney work product doctrine; deliberative process privilege; personally identifiable information protections; and other applicable federal laws, regulations, court orders, protective orders, and agency policies. Timely contractor support is urgent and necessary to assist OCC in meeting court deadlines, complying with discovery and production obligations, avoiding sanctions or adverse litigation consequences, protecting legally restricted information, and supporting CBP’s ability to carry out its lawful mission.
