The Department of the Army, Army Contracting Command - Rock Island (ACC-RI), on behalf of Pine Bluff Arsenal (PBA), intends to negotiate and award a sole source, firm-fixed-price contract to Bayer for the procurement of White Phosphorus.


This procurement is being conducted in accordance with FAR Part 12, Acquisition of Commercial Products and Commercial Services. The statutory authority permitting this sole source acquisition is 10 U.S.C. 3204(a)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements (and FAR 13.501(a) for commercial products).


The Government requires a reliable supply of White Phosphorus to support ongoing mission requirements at Pine Bluff Arsenal. A redacted copy of the Justification and Approval (J&A) supporting this sole source requirement is attached to this notice.


THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. A solicitation document will not be issued, and proposals will not be requested. However, any responsible source who believes it is capable of meeting the requirement may submit a capability statement, proposal, or quotation, which shall be considered by the agency.


Capabilities statements must provide clear and convincing evidence that the vendor can provide the exact required supplies. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
