NAVFAC Pacific is conducting a market survey to gather feedback from the construction community on the potential use of a Project Labor Agreement (PLA) for the upgrade of the standby power plant (Building #711) and electrical distribution system at the Pacific Missile Range Facility in Barking Sands, Kauai, Hawaii. The project involves extensive structural upgrades to the power plant building, including steel framing and foundation enhancements, replacement of asbestos siding with prefinished metal panels, and addition of specialized rooms such as control, telecommunications, and electrical switchgear areas. Upgrades to the exterior electrical distribution system will convert it to an underground, dual-feed, loop-configured primary system to support the Makaha Ridge facilities. The installation will include diesel engine-generators with auxiliary systems, and the project will comply with DOD Minimum Anti-Terrorism Standards for Buildings. Estimated construction costs range from $25 million to $100 million, with an anticipated performance period of approximately 835 days, and prime contractors are required to self-perform at least 20% of the work. The project will follow a design/bid/build delivery method under NAICS code 237130. This survey is not a solicitation or invitation to bid but a request for comments on the potential implementation of a PLA, a pre-hire collective bargaining agreement that sets labor terms for the project, which is encouraged under federal policy for large-scale construction. Respondents are invited to share information about previous PLA usage in Hawaii, availability of skilled labor, local labor disputes, expiring collective bargaining agreements, and potential benefits or drawbacks of a PLA related to cost savings, risk minimization, and efficiency improvements. The government’s intention is to assess whether a PLA would promote economy and efficiency in procurement while ensuring labor stability and compliance with labor standards. Responses are to be submitted by a specified deadline, with all information treated confidentially and used solely for planning purposes. No contract will be awarded based on this survey, and no clarifications or debriefings will be provided by the government.

Full Description

This is a Project Labor Agreement survey only. This is not a request for proposal, request for quote, or invitation for bid. There will not be a solicitation, specification, or drawing available at this time. NAVFAC Pacific is soliciting comments from the construction community addressing the potential use of Project Labor Agreements (PLA) for the titled project above. Project Description: Upgrade standby power plant Building #711 to provide sufficient generation capacity to support the range systems at Makaha Ridge. The power plant building is a low-rise, slab-on-grade, steel-framed structure. The steel framing and concrete footings will be upgraded. Building foundation work will include grade beams under the generator room and separate concrete pads to support the engine-generators (generators). Prefinished metal panels will replace existing asbestos containing wall siding and roof panels. Power plant will include a generator room with secured open storage, control room, restroom, coffee mess, telecommunications room and electrical switchgear room. Covered areas will be added for fire suppression equipment and mechanical pumps. Upgrade to exterior electrical distribution system to an underground, dual-feed, loop configured, primary electrical distribution system. The primary electrical distribution system will run underground from the utility-owned riser pole just outside the main gate, then along Makaha Ridge Road to the main switching station located in the power plant. The loop configured, primary distribution system will be routed from the main switching station in the power plant underground along Makaha Ridge Road and the northern boundary of Makaha Ridge to the electrical distribution system transformers that support the Makaha Ridge facilities. Project also provides secondary building service connections to the Makaha Ridge facilities from the upgraded electrical distribution system service transformers. Information systems include basic telephone and computer network systems and infrastructure. This project will provide Anti-Terrorism/Force Protection (ATFP) features and comply with ATFP regulations and physical security in accordance with DOD Minimum Anti-Terrorism Standards for Buildings. Built-in Equipment includes diesel engine-generators which include electrical load bank, electrical switchgear and electrical switchboard; fuel oil system; lube oil system; compressed air system; engine exhaust and emission control system; engine cooling system and bridge crane. This is a design/bid/build project. NAICS Code: 237130 - Power and Communication Line and Related Structures Construction. The magnitude of construction for this project is anticipated to be between $25,000,000.00 and $100,000,000.00. Prime Contractors must self-perform at least 20% of the work. The period of performance is anticipated to be approximately 835 calendar days. A PLA is defined as a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement as described in 29 U.S.C. 158(f). Federal Acquisition Regulation (FAR) Policy states: Project Labor Agreement (PLA) is a tool that agencies may use to promote economy and efficiency in Federal procurement. Pursuant to Executive Order 13502, agencies are encouraged to consider requiring the use of project labor agreements in connection with large-scale construction projects. An agency may, if appropriate, require that every contractor and subcontractor engaged in construction on the project agree, for that project, to negotiate or become a party to a project labor agreement with one or more labor organizations if the agency decides that the use of project labor agreements will (1) advance the Federal Governments interest in achieving economy and efficiency in Federal procurement, producing labor-management stability, and ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other matters; and (2) be consistent with law. Reference is made to provision, FAR 52.222-33 Notice of Requirement for Project Labor Agreement, and to clause, FAR 52.222-34 Project Labor Agreement. In consideration of the above factors, and any others which may be deemed appropriate, the construction community is invited to comment on the use of PLAs for this project. Of particular interest to the Government are responses to the following questions: 1. Have PLAs been used on comparable projects undertaken by the public or private sector in Hawaii? If so, please provide supporting documentation. 2. Does the local market have sufficient number of available skilled workers for a project of this magnitude? Are there other projects in the vicinity that will limit the pool of skill labor available for this project? Please elaborate and provide supporting documentation. 3. Are you aware of any past or current labor strikes or disputes that may impact this project? If so, please elaborate and provide supporting documentation. 4. Which Collective Bargaining Agreements will expire during the course of the project that may cause delays? 5. Could a PLA contribute to cost savings in any of the following: a. Harmonization of shifts and holidays between the trades to cut labor costs? b. Minimizing disruptions that may arise due to expiration of Collective Bargaining Agreements? c. Allowing for changes in apprentice-to-journeyman ratio? d. Serving as a management tool that ensures highly skilled workers from multiple trades are coordinated in the most efficient way? 6. Could a PLA minimize risk and contribute to greater efficiency in any of the following ways: a. Mechanisms to avoid delays? b. Compliance with Davis-Bacon and other labor standards, safety rules, EEO and OFCCP laws? c. Ensuring a steady supply of skilled labor in markets with low supply or high competition for workers? 7. Identify specific reasons why you do NOT believe a PLA would advance the Federal Government’s interest in achieving economy and efficiency in federal procurement. 8. Could a PLA increase costs on this project? If so, please elaborate and provide supporting documentation. This is not an announcement of the availability of a solicitation nor is it a means of generating a plan holders’ list. After review of the responses to this synopsis, a pre-solicitation announcement will be published in the Federal Business Opportunities (FedBizOps) if the Government intends to proceed with the procurement of this project. The Government will not contact the responders for clarification of information provided. This survey is for planning purposes only and shall not be construed as a Request for Proposal or as an obligation on the part of the Government. The Government does not intend to award a contract on the basis of this market survey or otherwise pay for the requested information. The Government will not provide a debriefing on the results of this survey. All information will be held in a confidential manner and will only be used for the purposes intended. The construction community is invited to answer and comment on the use of a PLA for the above titled project. Responses shall be submitted via email to Adele Murakami at contact@example.gov no later than 10:00 a.m. (HST) on Friday, 8 July 2016.
