The Department of the Navy, through the Space and Naval Warfare Systems Command (SPAWAR), plans to modify its existing contract with Hewlett Packard Enterprise Services (HPES) under contract N00039-10-D-0010 by increasing the contract ceiling by approximately $2.1 billion. The current ceiling of $3.391 billion is expected to be exceeded by September 2012, prompting an increase to a new ceiling of $5.51 billion. This modification is intended to ensure continuity of services for the Navy and Marine Corps Intranet (NMCI), a critical network infrastructure. The action is being conducted as a sole source modification based on the justification that HPES is currently the only responsible provider capable of maintaining uninterrupted service, as it controls much of the essential infrastructure and software used to deliver NMCI services. The Navy has made attempts to promote competition for future contract awards by acquiring government purpose rights to HPES’s intellectual property and including options to purchase hardware and infrastructure, allowing potential competitors increased insight into the network's architecture. Despite these efforts, the unique role and capabilities of HPES leave no viable alternative suppliers at present, supporting the decision to proceed without full and open competition. Questions regarding this contract modification can be directed to the designated Navy contact.

Full Description

The Department of the Navy, Space and Naval Warfare Systems Command (SPAWAR) intends to issue a contract modification to Hewlett Packard Enterprise Services (HPES) under contract N00039-10-D-0010 to increase the contract ceiling by $2.12B. The DoN estimates that based on current requirements, the contract ceiling amount of $3.391B will be exceeded in September 2012. This contract action will increase the ceiling from $3.391B by $2.1B to a new ceiling amount of $5.51B. This notice of intent is not a request for competitive proposals or quotes. A determination by the Government not to compete based upon responses to this notice is solely within the discretion of the Government. Authority for other than full and open competition is 10 U.S.C. 2304(c)(1) and FAR 6.302-1, only one responsible source and no other suppliers or services will satisfy agency requirements. The incumbent provider, Hewlett Packard Enterprise Services (HPES) is the only responsible source able to satisfy DON requirements at this time. No alternative source can ensure continuity of service without major disruptions. HPES currently owns and/or controls most of the critical infrastructure and computer software used to provide NMCI services. The DoN has actively worked to remove barriers to competition including purchasing Government Purpose Rights to HPES NMCI Intellectual Property and including options to buy HPES owned hardware and infrastructure. These steps have allowed prospective NGEN offerors to gain critical insight into the network architecture and operations which will promote full and open competition for NGEN. Questions concerning this proposed ceiling increase may be directed to Kim Reavis at contact@example.gov or telephone +1 (555) 000-0000.
