AI Contract Overview
The Department of Transportation, Maritime Administration, has issued a firm fixed price solicitation (RFQ6923G226Q000004) for the removal and installation of a new fuel dispensing system at the Yocum Sailing Center located at the United States Merchant Marine Academy (USMMA) in Kings Point, NY. The project includes removal of existing underground storage tanks, fuel dispensers, associated piping, and electrical systems, followed by installation of new systems in an approved location. The contract is a total small business set-aside under NAICS code 237120. The period of performance mandates completion within 90 days after Notice to Proceed. Key elements include coordination with USMMA Public Works, compliance with all relevant federal, state, and local regulations—including environmental and health standards—and obtaining necessary permits. Deliverables encompass removal and disposal of old equipment, installation of new infrastructure, soil testing, site restoration, and submission of engineering certifications and documentation. The procurement process has involved multiple amendments extending the proposal submission deadline to May 15, 2026, with three scheduled site visits allowing offerors to examine the project location. The solicitation requires three distinct proposal volumes: Technical Approach, Past Performance, and Price, with Past Performance questionnaires to be submitted directly by offerors’ references to the Contracting Officer. Evaluation is based on a Lowest Price Technically Acceptable (LPTA) basis, where the technical approach and past performance are rated pass/fail and equal in importance, and price becomes the determining factor among acceptable offers. The contract incorporates numerous FAR and TAR clauses covering government property protection, subcontracting, quality requirements, equal employment opportunity, safety reporting, and conflict of interest mitigation. Special contract requirements emphasize personnel security clearances for facility access, robust subcontractor reporting, prohibition of inherently governmental functions by contractor personnel, and prompt incident reporting. Invoicing is exclusively electronic via the Delphi eInvoicing portal. The Contracting Officer is Durba Ray, with primary points of contact provided for administrative and technical inquiries. The solicitation mandates strict compliance with prescribed submission formats, acknowledgement of all amendments, and flow-down of critical clauses to subcontractors.
