It is the intent of this agency to award a sole source contract under statutory authority of the test program for commercial items Section 4202 of the Clinger-Cohen Act of 1996, set forth in Federal Acquisition Regulation 13.501(a)1(ii), only one responsible source and no other supplies or services will satisfy agency requirements. This agency intends to award to K&R Custom Software, Inc., 739 Thimble Shoals Blvd. STE 302, Newport News, VA 23606-3562. 1. The 6th Communication Squadron requires technical maintenance/software support for K&R?s previously installed, maintained, and populated Telephone Management System (TMS). 2. The award of a contract for TMS technical maintenance/software support must be awarded to K&R Custom Software, Inc. because they engineered the TMS data base currently in use specifically to interface with MacDill AFB MSL-100 Telephone Switch. Due to proprietary rights and configuration knowledge it would prevent other companies from providing maintenance support and system upgrades unless system replacement takes place. Current replacement of the system is not cost effective for the government. 3. Market research was conducted for the purchase of TMS Maintenance and K&R Custom Software, Inc. is the only contractor found able to supply this item as we require. If no response to this notice is received by 3:00pm EST on Tuesday, December 18, 2007, the award for TMS System Maintenance will be made to K&R Custom Software, Inc.
