The Department of Homeland Security’s U.S. Immigration and Customs Enforcement, specifically the Enforcement & Removal Operations division, intends to award a sole-source firm-fixed price purchase order to the Pacer Service Center for access to the Public Access to Court Electronic Records (PACER) system. This access is deemed mission-critical for the ICE/ERO New York Field Office to support immigration enforcement actions by enabling instantaneous retrieval of federal court records, which are essential for identifying, locating, and acting on individuals subject to enforcement actions. The government has determined that no other provider can fulfill this requirement, as the PACER system is the exclusive source for electronic access to federal court documents, and market research confirmed no alternative solutions exist that meet the operational needs. The procurement will be conducted under FAR Part 13 procedures, utilizing the authority of FAR 13.106-1(b)(1)(i) to solicit from a single source, with no competitive process anticipated unless new information emerges demonstrating otherwise. This notice serves only as an announcement of intent and is not a request for proposals or quotes; responses to this notice will be reviewed solely to assess whether competition would be in the government’s best interest. Interested parties may submit documentation demonstrating their capability to provide the service by email to John.Cappello@ice.dhs.gov by 3:00 PM Eastern Daylight Time on July 28, 2026, with the subject line “Response to Notice of Intent- PACER System.” Submissions must be provided at no cost to the government, and no telephone inquiries will be accepted. The government retains the right to cancel the planned sole-source award at any time. The solicitation number is JA-26-0220, and the NAICS code is 519290.
