The contract involves a single source award valued at $73,902 to the Patent and Trademark Federal Credit Union (PTOFCU) for the partial upgrade of their Core Operating System, Mobile Banking Platform, and IBM I-7 Server used for PTOFCU ATMs. This upgrade is crucial to maintaining the integration and functionality of PTOFCU's existing IT system and continues the customization and maintenance relationship with CMC, the previous vendor that supplied the 2006 system upgrade and ongoing support for the server and software. Due to the specialized nature of the integration and the potential operational disruption, the USPTO has determined that sourcing from any vendor other than PTOFCU would be impractical and detrimental to service continuity. This acquisition is made under the USPTO's exemption from the Competition in Contracting Act and relevant acquisition guidelines, aligning with the single-source procurement process under the simplified acquisition threshold. The contract is associated with NAICS code 517911, which pertains to Telecommunication Resellers, and designates a federal supply code of 7050, related to ADP Components. The point of contact for this contract is Dru Olson, a Contract Specialist with the USPTO, and all work will be performed in Alexandria, VA. This contract is not open for competitive bidding, and no request for quote will be issued.

In accordance with U.S. Patent and Trademark Office's (USPTO) exemption from the Competition in Contracting Act and the Patent and Trademark Office Acquisition Guidelines (PTAG) and the Patent and Trademark Office Efficiency Act, 35 U.S.C. 2(b)(4)(A), the USPTO intends to issue a single source award in the amount of $73,902.00 under the simplified acquisition threshold to Patent and Trademark Federal Credit Union (PTOFCU) (DUNS Number: 108087628), 8520 South Sandy Parkway, Sandy, UT 84070 for Core Operating System Upgrade, Mobile Banking Platform, and IBM I-7 Server for the upgrade PTOFCUATMs. This acquisition involves the follow-on purchase of Core Operating System Upgrade, Mobile Banking Platform, and Server for the PTOFCU. The upgrade is a partial upgrade to the Credit Union's IT System. The installation and integration requires support and knowledge of the PTOFCU's IT system. The most recent upgrade was purchased from CMC by the PTOFCU in purchased in January 2006. The 2006 upgrade was customized to integrate with the PTOFCU's existing IT system and included the installation of CMC's Flex Software. This upgrade is also customized to integrate with the PTOFCU's existing IT system. The use of another vendor would cause disruption of service and require replacement of integrated peripheral IT items due to the integrated nature of the PTOFCU IT system. Additionally, purchase from another vendor would force the PTOFCU to change the vendor they contract with for maintenance. CMC provides maintenance support for the PTOFCU-owned Server and Flex Software. The PTOFCU will continue purchase system maintenance from CMC after the system has been upgraded. NAICS Code is 517911 (Telecommunication Resellers), Federal Supply Code is 7050 (ADP Components), and Small Business Size Standard is 1,500 employees. This is not a Request for Quote (RFQ). No RFQ will be issued.
