FAR 52.219-14 Subcontracting Limitations Defined

Offerors are advised that compliance with the Limitations on Subcontracting requirement will be evaluated consistent with applicable regulations and controlling legal interpretations.

For purposes of this procurement, the Government will assess compliance based on the percentage of the cost of contract performance incurred for personnel (for services contracts), as required by FAR 52.219-14 and implementing SBA regulations.

Offerors are specifically cautioned that:

  • The subcontracting limitation applies to the performance of the primary and vital requirements of the contract, not to administrative or incidental functions.
  • Activities such as invoicing, billing, contract administration, general management, or other back-office support functions do not constitute performance of the contract’s primary requirements.
  • Accordingly, such back-office or administrative functions will not be credited toward meeting the required percentage of work that must be performed by the prime contractor (or similarly situated entities, if applicable).
  • The Government will evaluate compliance based on the extent to which the prime contractor is performing the core labor categories and substantive technical requirements identified in the Performance Work Statement (PWS) or Statement of Work (SOW).

Failure to demonstrate compliance with these requirements may render a proposal ineligible for award or may result in a determination of noncompliance during contract performance.

For the avoidance of doubt, merely retaining functions such as contract billing or administrative oversight, while subcontracting the substantive technical work, does not satisfy the limitations on subcontracting requirement.

After COVID-19, the FBI was left with a surplus of expired hand sanitizer. Due to the high alcohol content, this material must be handled and recycled/disposed correctly according to EPA and DOT regulations.

The Contractor shall provide all services necessary to recycle or dispose of expired or unused hand sanitizer. Quantity is as follows: 82 full boxes on five pallets. Each box holds 12 bottles, approximately 2184 bottles in total. Each bottle is 750ml. The work includes pickup, transport, recycling/disposal, and provision of documentation in accordance with applicable Federal, State, and local regulations.

Questions are due 4/2/26 no later than 4pm EST. Questions must be submitted via email to mgolicz@fbi.gov via the questions Excel template.

Design-Build of a Tier II Mobile Command Post Vehicle (MCPV) Trailer
Solicitation # 15F06726R0000194
The Federal Bureau of Investigation is seeking a single-award, Firm-Fixed-Price, Indefinite-Delivery/Indefinite-Quantity contract for the design, engineering, manufacturing, and production of Tier II Mobile Command Post Vehicle (MCPV) systems. These systems consist of custom-integrated gooseneck trailers and compatible Class 4 prime hauler vehicles designed to support command, control, communications, and computer (C4) operations. The acquisition follows a phased design-build approach, requiring the contractor to produce a production-representative first article to establish a configuration baseline before proceeding to full-scale production. The government anticipates ordering approximately thirteen MCPV trailer systems and associated haulers over a contract period consisting of one base year and four option years, with a maximum contract value not to exceed $15,000,000. Award will be based on best value, with non-price factors weighted significantly more than price. Technical evaluation focuses on the proposed concept, engineering feasibility, and production capability, with a mandatory pass/fail requirement for ISO 9001 certification. The contractor is responsible for comprehensive lifecycle support, including integration of government-furnished equipment, technical documentation, and warranty administration. All deliverables must meet strict technical specifications and be verified through a Master Requirements Traceability Matrix. Administrative requirements include electronic invoicing via the Invoice Processing Platform and the protection of controlled unclassified information. Proposals must be submitted in four distinct volumes, adhering to strict page limits and native Excel format requirements for pricing and traceability matrices.
