This contract, titled "J065--AGFA Preventive Maintenance and Service Base+2," awarded by the Department of Veterans Affairs (VA), establishes a sole-source, firm-fixed-price agreement with AGFA US Corp. for preventive maintenance and support services of AGFA DR 400 imaging systems at VA healthcare facilities, including the Worcester Belmont Street Campus and VA Boston Healthcare System locations. The award is made under an existing IDIQ contract (VA797H-17-D-0004) based on the unique, proprietary nature of the equipment and software, which only AGFA US Corp. is authorized to service due to FDA regulations and cybersecurity requirements. The contract includes a base period of one year starting January 1, 2026, with two additional one-year option periods for 2027 and 2028, and a base year value of $26,676. No pricing is explicitly provided for the option periods. The contractor’s responsibilities include annual preventive maintenance, equipment repair, 24/7 technical support, remote diagnostics, priority on-site response, and parts replacement meeting or exceeding manufacturer specifications. Services must comply with VA security and privacy directives, including mandatory training for contractor personnel, immediate reporting of security incidents, and cooperation with VA and Office of Inspector General (OIG) investigations. The contract imposes liquidated damages for data breaches involving sensitive personal information. Routine maintenance involves electrical safety inspections and the submission of detailed service reports containing equipment identifiers and service details to the VA facility point of contact. Subcontractor use requires prior written approval, and all personnel must undergo background checks consistent with VA employee standards. The procurement is justified as sole source under FAR 16.505(b)(2)(i)(B) due to the technical exclusivity of AGFA’s proprietary systems, with no competition or socioeconomic set-asides applicable, and no standardized FAR clauses or packaging requirements are identified within the contract documentation.
