The Department of Homeland Security (DHS), Office of Procurement Operations (OPO), Information Technology Acquisition Center (ITAC), Office of the Chief Information Officer, (OCIO), Solutions Development Directorate (SDD), Research Library and Information Services (RLIS) intends to award a sole source purchase order to LeadsOnline, 6900 Dallas Parkway, Suite 825, Plano, TX 75024 for LeadsOnline Subscription Service. This solicitation document and incorporated provisions and clauses in effect through Federal Acquisition Circular (FAC) 2024-05, the North American Industry Classification System (NAICS) is 519290 with a business size standard of 1,000 employees. A quote is being requested under solicitation no. 70RTAC24Q0000097 using Simplified Acquisition procedures. This will be a Firm Fixed Price contract for a 12-month base period with four twelve (12) month option period. Based on DHS market research, it has been determined that LeadsOnline is the only source to meet DHS requirement and no other supplies or services will satisfy the agency requirements. The LeadsOnline system functionality designed specifically for criminal investigations using transaction data from pawnshops, scrap yards, eBay, OfferUp, gold buyers and other secondhand stores is the exclusive proprietary property of Leads Online and is protected under the United States Copyright Act (17 U.S.C.), as well as by all applicable state and international copyright laws, and by the Lanham Act (15 U.S.C. 1051-1141n). The proposed contract action is for LeadsOnline Subscription Service which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.501(a). This notice is not a request for competitive proposals. The following clauses and provisions are incorporated by reference and apply to the acquisition: FAR 52.212-1, Instructions to offeror-Commercial items (Sep 2023), FAR clause 52.212.-2, Evaluation Commercial Products and Commercial Services (Nov 2021) and FAR 52.212-4 Contract Terms and Conditions'Commercial Products and Commercial Services (Nov 2023).
