This action is being executed in accordance with the authority of RFO 6.103-1, Only one responsible source and no other supplies or services will satisfy agency requirements.


The United States Patent and Trademark Office (USPTO), Office of Procurement, proposes to exercise FAR clause 52.217-8, Option to Extend Services, on a basis other than full and open competition. This action will extend the Patent Technical Services (PTS) contract—a hybrid Firm-Fixed-Unit-Price and Labor-Hour contract competitively awarded to LHDTSV, LLC on September 27, 2021.


Although FAR 52.217-8 was included in the original solicitation and contract, the pricing for this extension period was not evaluated at the time of award, necessitating this justification. The proposed period of performance for this six-month extension is September 28, 2026 – March 27, 2027.
