The contract involves processing USDA donated food commodities for the 2026–2027 school year under the National School Lunch Program, with the Granite School District serving as the issuing agency. The procurement seeks qualified vendors approved by the Utah Child Nutrition office to process specific commodities including large chilled chicken, chicken legs, natural American cheese, and raw shelled peanuts. Bids are evaluated based on a combination of cost (60%) and taste, texture, visual appeal, and holding quality (40%), with awards made on a competitive, item-by-item basis to proposals most advantageous to the district. The contract is set to commence on July 1, 2026, and conclude on June 30, 2027, with potential for four one-year renewals, contingent upon mutual agreement. Vendors must submit samples, adhere to federal, state, and district specifications, and comply with all applicable food safety and procurement standards. The solicitation emphasizes strict compliance with federal regulations, including those outlined in 2 CFR Part 200 Appendix II, which mandates contractual provisions for non-federal entities, such as remedies, termination rights, and labor standards. It also incorporates Utah Code provisions that void unenforceable contract clauses, particularly restrictions on governmental immunity and indemnification. The process requires detailed proposal documentation, including certifications of proposal accuracy, debarment, lobbying activities, and Buy American compliance, with all submissions due via the Utah Public Procurement Place portal or in hard copy by the specified deadline. The contract stipulates delivery terms, with FOB destination or origin pricing options, and mandates that processed products meet USDA and FDA safety standards, including temperature controls, proper labeling, and traceability. Inspection and acceptance occur at the delivery site, with the district responsible for evaluating product quality against safety, appearance, and performance criteria, ensuring compliance with federal nutrition and safety standards. Overall, the contract aims to secure cost-effective, high-quality processing services aligned with federal and state regulations, supporting the district’s child nutrition program through a structured, competitive procurement process.
