Enforcement No. 2026-15769– Notice to Proceed with Compliance Plan and Schedule (Plan) for Pipe Removal and Site Restoration

The Central Valley Flood Protection Board is implementing a compliance plan under Enforcement Case No. 2026-15769 to remedy the unauthorized installation of an 8-inch diameter PVC pipe through the right bank of the Mormon Slough project levee. Located in San Joaquin County at Levee Mile 3.57, the project requires the excavation of the levee to a depth of 8 to 12 feet to fully remove the pipe and restore the site to its pre-project conditions. The restoration process involves using native, moisture-conditioned soil for compacted backfill applied in 4 to 6-inch lifts, with the levee crown being restored using 4 inches of aggregate base. To ensure quality and structural integrity, compaction tests will be conducted at every 1-foot interval. This project is classified as a forecast under NAICS code 237990 and is exempt from the California Environmental Quality Act under sections 15321, 15301, and 15304 due to its nature as a regulatory enforcement action with limited environmental impact. There is no proposed new development or expansion of use associated with this work. The project is managed by the Central Valley Flood Protection Board, with primary coordination handled by Senior Environmental Scientist Angela Nguyen-Tan.
