The Social Security Administration (SSA) plans to enter into a sole source contract with OPEX Corporation for the maintenance of three OPEX Multiple Purpose Extractor Model 7.5 units. This contracting approach is justified under the Federal Acquisition Regulation 13.106-1(b)(1) due to the unique proprietary diagnostic software OPEX uses, which is protected by patents and copyrights and not available to other service providers. The maintenance contract is expected to be a firm fixed price purchase order covering the period from February 2009 to February 2010. The contract will be awarded using simplified acquisition procedures without a competitive solicitation, and requests for solicitation copies will not be accepted. The point of contact for this action is James S. McDermott, the Contracting Officer at SSA, located in Baltimore, MD, with the maintenance to be performed in Wilkes-Barre, PA. Interested parties were invited to respond by January 30, 2009, although only OPEX Corporation is considered a reasonable source due to the proprietary nature of the equipment and software involved.
