ITEM DESCRIPTION- Naval Surface Warfare Center (NSWC) Crane has a requirement for the procurement of Test, Teardown, and Evaluation (TTE) for two Improved Night/Day Observation Device (INOD) Block (BLK) III night vision devices, serial numbers 01216 and 01222, and an option for any repairs required after the initial TTE.


SOLE SOURCE PROCUREMENT- The proposed contract action is for services for which the Government intends to solicit and negotiate with one source only DRS Network & Imaging Systems LLC, of Melbourne, Florida, Cage 32865, under the authority of FAR 12.201-1 for commercial services using simplified acquisition procedures. This is being solicited on a sole source only basis because The Original Equipment Manufacturer.(OEM) of the INOD BLK II system, Leonardo DRS LLC has proprietary rights to data, design, and manufacturing of these units and is not willing to provide the Government with the information to reverse engineer the system.  The TTE and Repair services required on these units are provided by DRS Network & Imaging Systems LLC, a division of the OEM. Purchase of repair services from another source would require extensive qualifications, design, and testing to ensure compatibility. This type of qualification and testing would cost the Government in excess of 5 years in time with an additional excess of over $10,000,000 in costs in engineering, manufacturing, logistics, and legal fees necessary.  These costs would not be recoupled in any competitive action.  All responsible sources may submit a capability statement, which shall be considered by the agency. However, a determination by the Government not to compete with this proposed contract based upon responses to this solicitation is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.

This solicitation is being issued pursuant to the procedures at FAR 12.201-1 as a written Firm Fixed Priced Request for Quotes .  Synopsis exception FAR 5.202(a)(13) applies and Solicitation Number N00164-26-Q-0262 is hereby issued as an attachment hereto.
